Hardware Warranty
Opus Hardware (Crest Group Limited) and its subsidiaries warrant that their products comply with the New Zealand Building Code, as it applies to hardware, subject to the following conditions:

All works using Opus Hardware are carried out in accordance with site-specific installation instructions and Opus literature.

Where a site-specific PS1 is required, it must be approved and signed off by Opus Hardware prior to the commencement of installation.

The exclusions outlined below.
Additionally, Opus Hardware warrants for 10 years that the hardware:
a. Is fit for all purposes for which it is commonly supplied;
b. Is acceptable in appearance and finish in accordance with the specifications relevant to the product type (e.g. powder coating, anodising, etc.);
c. Is safe and durable to meet the requirements of the NZ Building Code.
Note: Mechanical or electrical hardware carries a different warranty period. In these instances, Opus warrants the following listed products for 5 years:

All mechanical hinges

Opus OFS840 & BTS80 Floor Springs

All Dormakaba Floor Springs

All sliding door systems (see Section 4)
Subject to the terms of this warranty, the company will either repair or replace any defective products and may require the return of the defective items to Opus (freight prepaid). The company reserves the right to inspect the installation in situ (i.e. on-site) and/or request on-site proof from the user or installer (where a technician is unavailable) to assess the validity of the claim.
What Does This Warranty Exclude?
The warranty shall not apply where any of the following circumstances exist, and Opus Hardware will not be liable for any resulting loss or damage:
a) Any act, default, omission, or misrepresentation by any party other than Opus Hardware (Crest Group Limited), its employees, or agents.
b) Improper handling or failure to follow Opus Hardware’s instructions.
c) Improper usage.
d) Failure due to faulty installation, building construction, or design. This includes any defect caused by the structure to which the hardware is affixed or due to incorrect installation.
e) Glass breakage (except where explicitly covered under third-party warranties). Contact your glass provider for third-party warranty details.
f) Any defect in materials covered under another supplier’s warranty.
g) Damage or deterioration from causes beyond Opus Hardware’s control, including but not limited to: impact, abrasion, natural disasters (earthquake, flood, fire, etc.), pollution, extreme weather or coastal conditions, chemicals, attempted unauthorised repairs, or malicious damage.
h) Failure to maintain surfaces in accordance with the care and maintenance procedures provided by Opus or its suppliers.
i) Hardware that appears similar to Opus Hardware products but was not supplied by Opus.
j) ‘Fair wear and tear,’ as defined in the care and maintenance document.
k) Failure to comply with the care and maintenance document.
l) Any direct, indirect, special, consequential, or third-party claims for loss, damage, or expense.
m) Transfer of the warranty without prior written consent from Opus Hardware.
n) Any liability exceeding the original invoice value of the hardware product in question.
o) Any product for which the purchase price remains unpaid in full or in part, or where the customer is in default under the supply agreement.
p) Failure to lodge a written claim within 30 days of the defect arising or being reasonably discoverable.
q) Installation of a product that was already defective at the time of receipt. Products must be inspected prior to being taken to site. Opus Hardware is not liable for off-site installation assistance or any costs incurred due to overlooked defects. Based on this exclusion, Opus is not liable for excess costs or fees incurred by the user or installer due to pre-existing issues with the product.
Legal Disclaimer
This warranty does not limit or affect any rights the purchaser may have under the Building Act 2004, Fair Trading Act 1986, Consumer Guarantees Act 1993 (CGA), or any other applicable legislation.
However, where hardware or glass is supplied for business purposes, the guarantees under the CGA do not apply. If the customer resells the goods, they must contract out of the CGA (and other consumer laws) to the extent permitted by law and in writing, wherever the goods are sold for business purposes.
Opus Hardware (Crest Group Limited) reserves the right to inspect, in the field, any hardware or glass subject to a claim under this warranty or applicable legislation, including the CGA.
